PHOTO GALLERY TERMS & CONDITIONS

By accessing, viewing or entering this photo gallery, or any other photo gallery operated by OneEyedFrog Photography®, you acknowledge and agree to the following Terms & Conditions. If you do not agree to these Terms & Conditions, you must not access, view, download, copy or otherwise use any images displayed in the gallery.

1. COPYRIGHT OWNERSHIP

All photographs and images displayed in this gallery are the exclusive intellectual property and copyright of OneEyedFrog Photography®, unless otherwise expressly stated in writing.

All images are protected under applicable Australian copyright law, including the Copyright Act 1968 (Cth).

Copyright remains with OneEyedFrog Photography® at all times unless expressly transferred or licensed in writing.

2. GALLERY & PROOF IMAGE ACCESS

Gallery access is provided for personal viewing and image selection purposes only.

Images displayed as proofs are low-resolution, watermarked images intended solely for viewing and selection prior to purchase.

Viewing an image does not grant any licence, ownership, copyright, reproduction, publication, social media, commercial or other right to use the image.

Screen-capturing, copying, sharing, reproducing, publishing, posting to social media, using AI to remove or alter watermarks, or any other unauthorised use of proof images is strictly prohibited.

3. STRICTLY PROHIBITED USE 

You must not, without prior written permission from OneEyedFrog Photography®:

• Download, screen-capture, photograph, copy, reproduce or save proof images
• Share, transmit, distribute or provide proof images to any third party
• Post or publish proof images on social media, websites, forums, publications or other platforms.
• Reproduce, print or otherwise make copies of proof images
• Crop, edit, alter, manipulate, trace or otherwise modify images
• Remove, obscure, cover, bypass or digitally alter any watermark or copyright notice
• Use AI, generative AI, image-editing software or any other technology to remove or alter watermarks or copyright notices
• Use images for advertising, promotional, commercial, editorial, business, club, sponsor, publication, branding or other purposes
• Supply images to another photographer, designer, artist, business, organisation, website, publication or other third party
• Use any image in connection with artificial intelligence, machine learning, image generation, image manipulation or AI training

4. NO LICENCE OR REDISTRIBUTION

Unless expressly purchased or licensed in writing, no rights are granted to download, reproduce, publish, distribute, transmit, modify, display, sell, licence, transfer or otherwise use any image.

Images may not be distributed, sold, licensed, transferred or supplied to any third party without the prior written permission of OneEyedFrog Photography®.

Purchase of a digital image does not transfer copyright ownership unless expressly agreed in writing.

5. UNAUTHORISED USE & FEES

Any unauthorised downloading, screen-capturing, copying, reproduction, publication, distribution, social media posting, watermark removal, AI manipulation or other unauthorised use of a proof image is strictly prohibited.

Unauthorised use may incur a fee of $150 per image, in addition to any applicable licensing fees, damages, recovery costs or other amounts that may be available under applicable law.

Unauthorised use may also result in the suspension or deactivation of your OneEyedFrog Photography® website account and/or gallery access.

Payment of any fee does not automatically grant a licence or permission to use the image.

6. MONITORING & ENFORCEMENT

OneEyedFrog Photography® reserves the right to monitor and investigate suspected unauthorised use of its images.

Unauthorised copying, downloading, reproduction, publication, distribution, watermark removal or other use may constitute an infringement of copyright and may be pursued accordingly.

7. LEGAL RIGHTS

OneEyedFrog Photography® reserves all rights available under applicable Australian law.

Unauthorised use may result in financial liability, damages, legal costs, account suspension, removal of infringing material and/or legal proceedings, where applicable.

Nothing in these Terms & Conditions limits any rights or remedies available to OneEyedFrog Photography® under applicable law.

8. ACCEPTANCE OF TERMS

By clicking “I Agree”, entering the gallery or otherwise accessing or viewing the images, you acknowledge that you have read, understood and agreed to these Terms & Conditions.

If you do not agree to these Terms & Conditions, do not enter or use the gallery.
